Welcome to Schramm Physical Therapy and Performance PLLC d/b/a Dryland Performance (“Dryland Performance,” “Company,” “we,” “our,” or “us”). By purchasing, accessing, or participating in any Dryland Performance program, coaching service, website content, or digital product, you agree to these Terms of Service.
If you do not agree to these Terms, do not use our website, services, or products.
1. Eligibility
You must be at least 18 years old to purchase products or services from Dryland Performance.
If the participant is under 18 years old, a parent or legal guardian must complete the purchase and agree to these Terms on behalf of the minor participant.
2. Nature of Services
Dryland Performance provides:
- General fitness programming
- Strength and conditioning education
- Swim-specific performance education
- Exercise demonstrations and coaching guidance
- Educational content related to movement and training
Dryland Performance does not provide:
- Medical advice
- Medical diagnosis
- Physical therapy treatment
- Rehabilitation services
- Individualized healthcare services
Participation in Dryland Performance programs does not create a patient-provider relationship.
3. Payment and Pricing
Prices are listed at checkout and may change at any time for future customers.
Payments are processed securely through third-party payment processors including Stripe.
You agree to provide accurate billing information and authorize Dryland Performance to charge the payment method provided.
4. Refund Policy
Self-Guided Programs
Self-guided digital programs are eligible for a full refund within 14 days of purchase.
Refund requests must be submitted via email to: mark@drylandperformance.com
Approved refunds are typically processed within 5 to 10 business days.
Coaching Programs
Programs that include group coaching or 1:1 coaching may not be eligible for full refunds once coaching services, consultations, or live sessions have been delivered.
Dryland Performance reserves the right to issue partial refunds at its discretion for coaching-based products.
5. Intellectual Property
All content provided by Dryland Performance, including but not limited to:
- Videos
- Exercise libraries
- PDFs
- Programming
- Educational materials
- Branding
- Logos
- Written content
- Methodologies
is the exclusive property of Schramm Physical Therapy and Performance PLLC d/b/a Dryland Performance.
Purchase grants you a limited, personal, non-transferable, non-commercial license to access and use purchased materials.
You may not:
- Share account access
- Redistribute materials
- Repost program content
- Sell or sublicense content
- Screen-record videos
- Download or reproduce proprietary materials
- Use content for commercial coaching purposes
Unauthorized use may result in account termination and legal action.
6. Account Use
Only one user may access each purchased account.
Account sharing is prohibited.
Dryland Performance reserves the right to suspend or terminate accounts that violate these Terms.
No refunds will be provided for account termination resulting from policy violations.
7. Assumption of Risk
Participation in exercise and training activities involves inherent risks, including but not limited to:
- Muscle strains
- Tendon injuries
- Joint injuries
- Falls
- Overexertion
- Aggravation of existing conditions
You voluntarily assume all risks associated with participation.
8. Limitation of Liability
To the fullest extent permitted by law, Schramm Physical Therapy and Performance PLLC d/b/a Dryland Performance and its owners, contractors, coaches, and affiliates shall not be liable for indirect, incidental, consequential, or special damages arising from participation in any program or use of any content.
Total liability shall not exceed the amount paid by the customer for the applicable product or service.
9. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Washington.
10. Changes to Terms
Dryland Performance reserves the right to modify these Terms at any time.
Updated Terms become effective immediately upon posting.
Continued use of the website or services constitutes acceptance of revised Terms.
